Fabric Nightclub – the story of death and drugs

Last summer, two young men tragically died in two separate incidents at the iconic Fabric nightclub in London.  Fabric lost its license and closed its doors to the public.  Following the creation of strict new conditions and anti-drug policies, Fabric re-opened.

As a club owner, what can we learn from the tragic situation at Fabric?

For Owners and Managers of Nightclubs, the sad loss of two young people while clubbing reminds us of many invaluable lessons.

  1. Nightclubs have a Duty of Care – You want a club that is successful, busy and popular. But, you must always remember your responsibility to your customers and your duty to give them a clubbing experience that is safe.  You’re in charge of the running the club so make sure that you’re running a club where people can enjoy themselves, have fun and be safe at the same time.
  1. You’ll need a zero tolerance approach –Keeping your customers safe is as important keeping them happy and entertained, so make it your top priority to have a zero tolerance approach to drugs. Keeping drugs out of your club will keep everybody protected and you from possible ending up in jail.
  1. You must be vigilant – If you’re going to follow a zero tolerance approach to drugs, you must be vigilant. To have a drug free club and a safe environment, you and your staff will need to be alert, aware and above all, trained!
  1. Your License is your livelihood – Without this you have no club. If you’re the kind of nightclub owner that understands this simple fact then you’ll do everything to make sure you don’t lose it. Once gone, it’s usually difficult to get back.
  1. Your insurance would be invalid – While you’ve probably been practical and made sure your Nightclub Insurance covers your Assets plus Public and Employers Liability, a drug-related incident can invalidate your insurance. This can bring severe legal and financial consequences for your Nightclub, Managers and Owners.
  1. Your business could possible fail – If a tragedy happened at your club and it ended up being closed down, there would be a massive financial impact. Even though you’d have no money coming in, you could still find yourself with money going out to all of your on-going commitments such as payments to suppliers, staff, VAT and HMRC.   And if your insurance also becomes invalid because of what’s happened, you are financially liable.

When a major Nightclub Insurer goes bust – what can we learn?

At the end of last year, a huge player in the nightclub insurance industry went bust. They were really popular with Bars and Nightclubs, but then they crashed and burned.

When this happened, loads of Bars and Nightclubs ended up with invalid policies.  They found their businesses simply weren’t insured anymore when their insurer went bust.  They had to go and get themselves a new policy pretty fast – just in case something bad happened (like a customer slip’n’trip) and they weren’t covered!

Pissing Punters and Nightclub Insurance…(?)

Once in a while we get a funny one in Nightclub Insurance…

Although amusing, it’s actually quite serious..

An inebriated punter (patron) took to relieving himself all over the amps of the club’s sound system in full view of everyone and right at the busiest time at the club… obviously an attention seeking performer here (?)

Happily no one got electrocuted or injured but it knocked out the club’s sound system for the rest of that night to the disappointment of hundreds of clubbers.

The club owner is now making a claim for the damaged (useless) electronic equipment and Loss of Earnings on his Nightclub Insurance as the club had to close down that night.

Both events will be covered under the policy but there is a serious lesson to be learned here.

Don’t leave your Club uninsured even for a minute as something like this, or even a slip & trip, can be catastrophic (especially if injury takes place) and very costly for the club owner.

It’s a classic case of someone trying to make a buck on the back of someone else.

“ .. I have recently received the paperwork for the unmitigated work of fiction created by one of our so called patrons..

We neither know the claimant by sight or name, and cannot identify any incident of this type and after seeing him in the street a few days later can verify the injury we see here as being on the wrong side. An ambulance was not called, the Police did not attend, our First Aider did not treat anyone and I was not informed of any incident, no accident book entry and as the Police specified data retention time of 31 days has passed by some months…. no CCTV footage either.

No idea what planet this guy was on when it happened, but it wasn’t ours. Houston!?  They have a problem…

HOW TO Avoid Trouble with ALCOHOL

There is no doubt that sometimes alcohol and people do not mix well. Whilst it is often amusing to see men and women staggering out of nightclubs and bars trying to walk in a straight line, singing incoherently, there lies a huge problem lurking around the corner.

In the United States and Canada there has long been a legal link between persons injuring themselves (and others) as a result of having “one too many” and those who sold them the alcohol in the first place. Premium and excess for pubs and clubs in North America are now sky high for those that can still get insurance (and some cannot). The problem has now reached Australia and South Africa and it will not be long before it reaches The United Kingdom and The Republic of Ireland. (There have already been some out of court settlements).

The ONLY defence you have to such an action is to show that you took all reasonable precautions to prevent visitors to you premises, either, gaining access if they are intoxicated, drinking too much once they are in or if they become intoxicated to get them off the premises and home safely.

So what are reasonable precautions? “Reasonable” is what the judges of the land decide on any given day so that there is no definitive list. Doing nothing is certainly not reasonable but spending a little time and effort on the following pointers (most will cost you nothing financially) will go a long way to showing the courts that you take the matter in hand very seriously and you have done all that a reasonable man or woman could be expected to do.

The following pointers have been used SUCCESSFULLY in other countries to defend alcohol-related incidents.
FOR THOSE SERVING ALCOHOL

1. IF IN DOUBT ASK FOR AGE IDENTIFICTION. YOU MUST NEVER SERVICE A MINOR

2. DO NOT ALLOW ENTRY TO ANYONE WHO IS INTOXICATED. POLITELY SUGGEST THEY GO HOME. TELL THEM WHERE TO GET A CAB.

3. DO NOT ALLOW YOU STAFF TO DRINK. THEY NEED TO REMAIN SOBER AND ALERT.

4. DO NOT SERVE AYONE WHO IS CLEARLY WORSE FOR WEAR. YOU CERTAINLY MUST NOT ENCOURAGE EXCESSIVE ALCOHOL CONSUMPTION.

5. STOP ANTI SOCIAL BEHAVIOUR IMMEDIATELY. ENSURE THE ENVIRONMENT IS SAFE FOR EVERYONE.

6. REMAIN CALM AND COMPOSED IN DIFFICULT SITUATIONS.
7. IF A GUEST DOES BECOME INTOXICATED ARRANGE FOR SAFE TRANSPORT HOME. HAVE AN ARRANGEMENT WITH A LOCAL CAB FIRM.

8. IF AN INCIDENT DOES OCCUR RECORD IT IN A LOGBOOK AND BRING IT TO THE ATTENTION OF MANAGEMENT. THE LOGBOOK NEEDS TO BE QUITE COMPREHENSIVE. “I.E. JOHN MURPHY REFUSED ALCOHOL AT 10:30PM AS HE APPEARED WORSE FOR WEAR. EJECTED BY SECURITY. POLICE CALLED WHEN SCUFFLE STARTED.” ENSURE THE PERSON ENTERING PRINTS NAME AND DATES THE ENTRY.

9. ASSIGN A MEMBER OF STAFF TO MONITOR THE PREMISES AND GUESTS.

10. ENSURE YOU HAVE ENOUGH STAFF TO DEAL WITH THE NUMBER OF GUESTS YOU HAVE. DO NOT OVERCROWN THE PREMISES

PROMOTE ALTERNATIVE BEVERAGES AND FOOD

1. SET PRICES FOR NON-ALCOHLIC DRINKS THAT ARE COMPETITIVE WITH ALCOHOLIC PRODUCT PRICES.

2. ADVERTISE AND PROMOTE NON ALCOHOLIC DRINKS ON THE DRINKS CHARTS AND MENUS.

3. STOCK AND PROMOTE LIGHT AND NON-ALCOHOLIC BEER AND WINE.

4. MAKE LIGHT AND NON-ALCOHOLIC BEER AND WINE CHEAPER THAN THE “REAL THING”.

5. DO NOT PAY STAFF BONUS’S ON HOW MUCH ALCOHOL THEY SELL. PAY THEM EXTRA TO SELL NON ALCOHOLIC BEVERAGES.

6. SERVE ALCOHOL FREE DRINKS IN CONTAINERS THAT ARE EASILY IDENTIFIABLE FROM THOSE THAT CONTAIN ALCOHOL.

7. PROVIDE A RANGE OF FOOD MENU SELECTIONS.

8. OFFER REDUCED PRICES FOR FOOD IN THE LATE AFTERNOON AND EARLY EVENING.

9. STOCK SNACKS AT ALL TIMES AND AVOID SELLING SALTY PRODUCTS (THEY MAKE PEOPLE THIRSTY).

10. CONSIDER A BONUS SCHEME FOR STAFF TO SELL MORE FOOD.

11. TYPE UP THE HOUSE RULES AND MAKE SURE EACH MEMBER OF STAFF SIGNS A COPY. MAKE IT CLEAR A BREACH OF HOUSE RULES IS A DISCIPLINARY OFFENCE. TRAIN YOUR STAFF AND RETAIN THEM. TRAINING SHOULD INCLUDE HOW TO SPOT INTOXICATION AND HOW TO DEAL WITH IT.

Some more Tips and Hints

1. DO NOT ENCOURAGE EXCESSIVE DRINKING BY OFFERING CHEAP ALCOHOL ON CERTAIN DAYS. SPECIALS OR “HAPPY HOURS” ARE NO LONGER ACCEPTABLE.

2. DO NOT HAVE A LAST ORDERS REGIME THAT ENCOURAGES A LAST MINUTE RUSH. DO NOT KNOWNGLY SERVE A GUEST SEVERAL DRINKS JUST BEFORE CLOSING TIME UNLESS HE CLEARLY IS BUYING FOR A GROUP.

3. AVOID SERVING DOUBLES.

4. DO NOT PROVIDE ALCOHOL AS PRIZES FOR SPECIALTY NIGHTS SUCH AS QUIZZES ETC.

5. UNDER NO CIRCUMSTANCES SHOULD COMPETITIONS INVOLVING DRINKING BE ALLOWED. THE “YARD OF ALE” COMPETITION SHOULD BE RESIGNED TO THE DUSTBIN.

6. ENCOURAGE GROUPS OF PEOPLE TO ALLOCATE A NON DRINKER. THE PERSON DESIGNATED CAN THEN SAFELY DRIVE HIS FRIENDS HOME. YOUR STAFF CAN IDENTIFY THE NON DRINKER AND ENSURE HE ONLY GETS NON ALCOHOLIC BEVERAGES.

7. PLACE INFORMATION LEALETS AROUND THE PRREMISES ADVERTISING CAB NUMBERS TO ENCOURAGE PEOPLE NOT TO DRINK AND DRIVE.

Tips and hints for running a successful nightclub – an Insurance Perspective

In these clearly claims conscious times you will have noticed that you are probably paying much more for your Nightclub Liability Insurance than ever before and you may also have an excess which means that you are having to contribute a significant amount towards each claim. All this is off your bottom line profit.
Whilst most claims are reported within a short period of time some do not arrive until SIX months or more have elapsed. That’s why you must keep your records up-to-date and available. Keep your staff rota sheets for at least 24 months – it is imperative that we know who to interview in the event of a claim.
Listed below are several ways, but not all, that you can reduce your exposure to claims and keep your premiums and excesses to a minimum.
1 – Install CCTV cameras at strategic positions throughout the club and at the entrance. Most security staff issues occur at the entrance. Keep the tapes/discs for a minimum of twenty-four months. If twenty-four months is not practical at least keep the tape/discs desk of incidents for a minimum of twenty-four months.
2 – Keep the dancing area free from drinks and broken glass. Allocate a member of staff to clear glasses regularly and have a system in place to deal with spillages. Slips on wet floors and glass (Slips & Trips) are a major source of claims – make sure it’s not you!
3 – Have a clear and concise door policy. Keep out undesirables and known troublemakers.
4 – Train your security staff in anger management and conflict avoidance to be able to deal with difficult situations. There must be no use of the Full Nelson Hold – Remember your policy excludes deliberate acts by security staff. Always use SIA registered and approved staff.
5 – Have a regular rota for toilet cleaning. Wet floors in the toilet area are a major cause of claims.
6 – Ensure all sub-contractors, whether they be DJs, security staff, live acts or the repair man, have their own insurances. Your broker will help you check this.

3 SIMPLE REASONS WHY NIGHTCLUB INSURANCE CLAIMS GET REJECTED

THE 80s were in full swing when we decided to get into the nightclub insurance business.

‘Why then?’ we hear you ask.

Well, we were all pretty insurance-minded to begin with and then we heard that song by Wham (no, not Wake Me Up Before You Go-Go).

The one that goes: ‘Club Tropicana, drinks are free, Fun and sunshine – there’s enough for everyone.’

A great celebration of nightclub fun, you might think.

It also sent a shiver down our spines. Free drinks? What if an unsuspecting reveler chugs down the free booze, is sick and puts in a claim? What if Club Tropicana doesn’t have the proper public liability cover in place? They’ll have to play for the claim out of their own pocket. They’ll have to call a halt to the free drinks, not to mention the boast of ample ‘fun and sunshine.’

We knew something had to be done, so we set about putting together the best nightclub insurance policies on the market at prices that wouldn’t break the bank – okay, so maybe Club Tropicana had to knock the free drinks on the head, but they did make a great saving on employers’ liability cover and got excellent legal cover thrown in too.

With over 25 years experience in the insurance business, there isn’t much we haven’t seen (that includes the dodgy haircuts and questionable fashion).

We also know the main reasons why insurance companies will turn down nightclub insurance claims.

Insurance will form a large part of your annual budget, so don’t waste money by taking out a policy which will ultimately prove worthless when you need to make a claim.

One of the most common reasons for insurers not paying out on a claim is because the nightclub owner has not given all the relevant information needed when taking out the policy.

When filling out the application form, make sure you answer every question as accurately and honesty as possible. Unfortunately, saying ‘I forgot’ isn’t going to cut it with an insurer who is deciding whether to write you a cheque for potentially thousands of pounds.

You may think that your previous business interests don’t matter. However, if you fail to let your insurer know that you were once the director of a business, they may not look to favourably on a claim once you all of sudden remember that time you sat on the board of a now defunct company.

Naturally, as a business owner, you’ll always be looking at ways of cutting your costs. However, when it comes to nightclub insurance, you can’t afford to cut corners. If you underinsure your business, you may find that an insurer may dramatically reduce the value of any future claim or even flat out refuse to give you a penny.

In a bid to reduce insurance premiums, some nightclub owners may insure their business for an amount which is much lower than it is worth.

Underinsuring won’t only affect future claims, it could put your whole business into jeopardy.

If you are unsure about how much your nightclub is worth, get it valued before you take out nightclub insurance so you’ll have an accurate idea of the amount to insure for.

Insurers are quite interested in history, although they’re not really into visiting Stonehenge or reading up on the Battle of Hastings. They’ll always ask you if you’ve had any previous claims, usually within the last five years.

Again, you’ll need to be up front and honest and let them know about your claims history, otherwise they could reject any future claims.

Injury to Customer

If a nightclub owner engages the services of a doorman via a security company and one of the doormen hits and injures a customer who is responsible for the wrongdoing? Is it the doorman or the nightclub?

Generally speaking, Doorman Insurance covers the liabilities of the doorman but an employer is also responsible for its employees’ acts during the course of their employment. So what happens if the ‘employee’ (in this case the doorman) is supplied by another organisation?

In principle, if the nightclub exercises sufficient control over the doormen in terms of direction, supervision, dress code and follows directions from the nightclubs own employees, it could be deemed the doorman to be a nightclub employee.

Also the period of time could be a deciding factor in whether the doorman has been integrated in the nightclub’s workforce and culture.

A customer’s injury could result in court awards for hundreds of thousands of pounds depending on the seriousness of the injury, long term rehabilitation, medical care and potential loss of earnings.

Clubbers die at North London Nightclub – Your Nightclub Insurance?

Two young men aged 20 and 21 died probably from rogue ecstasy tablets last November at a north London venue.

DI Rita Tierney said: “Although it is too early to say what caused these men’s health to deteriorate, We are investigating the possibility that illegal drugs may have been used.”

Now, how does this affect your own Club and nightclub insurance?

A couple of points spring to mind…

Firstly, does your club have a drugs prevention policy and is it enforced? Door supervision is your first line of defence where they search and arrest persons at entry stage. Also, internally, both security staff and club staff have to work in tandem to deter any dealing.

Most importantly, if the Police suspect dealing is taking place they can close your club down. There goes your livelihood and which also may take months to re open your venue.

Finally a little hint… if your insurer has any reason to believe your measures are ineffective or lax they may decline to insure you which could mean you will have trouble finding cover in the future. Take heed…
